2016 Judicial Retention Recommendation for the Florida Supreme Court and the 1st, 2nd, 3rd, 4th, & 5th District Court of Appeals

The Importance of Judicial Elections

Activist Judges in America have accomplished in the courts what the House and Senate couldn’t accomplish legislatively. They’ve twisted and changed the constitution to create case law to “justify” removing prayer, the Bible, and the Ten Commandments from public classrooms and nearly every area of public life. They’ve created a right to privacy that first allowed married couples to purchase contraception. This new right was then extended to unmarried couples and then further extended to allow a woman the “right” to pay an abortionist to murder her preborn child. This right was later extended to homosexuals convicted of sodomy. One can only wonder what will be the next step.

Our founding fathers feared that the courts would one day rule our country and strip our freedoms from us. As Thomas Jefferson noted, “Our judges are as honest as other men, and not more so. They have — with others — the same passions for party, for power, and the privilege of their corps. . . . And their power the more dangerous as they are in office for life and not responsible — as the other functionaries are — to the elective control.”

In the Federal Court system, we have no way of reigning in the judiciary short of impeachment, and impeachment is rare. In Florida, however, Justices come up for retention votes after originally being nominated by the Governor. Sadly, most Floridians pay little attention to the judges up for retention which is why they normally are retained with 65 – 75% of the vote. This must stop, we need a network of attorneys statewide to be constitutional watchdogs in the courts by reporting on how the judges rule on various issues before them, and we the people need to educate ourselves and cast out the judges who view our constitution as “a mere thing of wax in the hands of the judiciary, which they may twist and shape into any form they please.” (Jefferson.) Below are my recommendations for the FL Supreme Court and 1st, 2nd, 3rd, 4th, and 5th District Court of Appeals. Following my recommendations, I will explain the rationale behind my recommendations on the Supreme Court justices. Please note that this information is partisan. Florida Supreme Court Justices Up for Retention Rationale

Justice Charles T. Canady, Vote Yes to Retain

Appointed by: Governor Charlie Crist.

Justice Canady is a solid conservative who has served as a US Congressman and an attorney for Florida Governor Jeb Bush. As a Congressman, Canady voted for prolife legislation, voted to ban homosexual marriage, to limit welfare to two years and cut welfare spending, and to give poor kids Opportunity Scholarships to attend private schools. Canady served as one of the prosecuting attorney’s in President Bill Clinton’s Impeachment trial. As a lawyer for Governor Jeb Bush, Canady defended Opportunity Scholarships against legal challenges. Canady serves on the board of a home for unwed mothers. Canady’s nomination received praise from conservatives and the presidents of the Cuban American Bar Association and the Florida Chamber of Commerce but drew criticism from the ACLU director. While being sworn in, Canady asked, “For those of you who pray I ask that you pray that I will always judge with wisdom and integrity as a faithful servant of the Lord.”

Canady wrote the dissenting opinion on Amendment 9, arguing that the court should have allowed the amendment to stay on the ballot. Amendment 9 would have given Floridians the right to decide whether to participate in the Federal health care system or not. (HealthCareNewsFlorida.org)

Justice Jorge Labarga, Vote No to Not Retain

Appointed by: Governor Charlie Crist.

In 2000, Justice Jorge Labarga played a role in the hanging chad case in Palm Beach County ruling that election officials “could not necessarily disregard irregular chads that had not been fully punched out on ballot cards.” (www.nydailynews.com)

In 2008, Labarga made threatening comments about an attorney. “When you pick a fight with a judge, ultimately, you are gonna lose. Not today, but five years from now, 10 years from now, six years from now. That judge is going to remember you, always, always,” Labarga said.

“And, you know, when you do — there is an old saying that if you go after a judge, you better kill him. Because, like I said, it’s true.” (judicialtransperancynow.blogspot.com)

Labarga also was one of five justices to vote to take Amendment 9 off of the ballot. Amendment 9 would have given Floridians the right to decide whether to participate in the Federal health care system or not. (HealthCareNewsFlorida.org)

Justice James E.C. Perry, Vote No to Not Retain

Appointed by: Governor Charlie Crist.

Justice James E.C. Perry was Governor Charlie Crist’s four supreme court appointment. In appointing Perry, Crist passed by a candidate who was better qualified and was endorsed by “the Florida Police Benevolent Association, law enforcement officials, the National Rifle Association, Florida Right to Life, Florida Family Action, and dozens of other pro-life and pro-family groups around the state and across the country.” (HumanEvents.com) Perry on the other hand was endorsed by Planned Parenthood, the nations largest abortion provider, the NAACP, a leading homosexual activist group, and several other liberal groups.

Perry joined Labarga as one of five justices to vote to take Amendment 9 off of the ballot. Amendment 9 would have given Floridians the right to decide whether to participate in the Federal health care system or not. (HealthCareNewsFlorida.org)

Justice Ricky L. Polston, Vote Yes to Retain

Appointed by: Governor Charlie Crist.

Justice Ricky L. Polston is a solid conservative. Prior to becoming a Justice, he defended the state’s “Choose Life” license plate in court. The Choose Life license plate allows owners of automobiles to pay an additional amount with their tag that goes to mothers who choose to give their baby up for adoption. As an appellant court judge, Polston wrote a dissenting opinion in favor of opportunity scholarships (vouchers). Polston has four biological children and has adopted six children from Florida’s foster care system.

Polston joined Canady in a dissenting opinion where Canady argued that the court should have allowed Amendment 9 to stay on the ballot. Amendment 9 would have given Floridians the right to decide whether to participate in the Federal health care system or not. (HealthCareNewsFlorida.org)

    Thanks for the insight to where these Supreme Court Justices stand on the issues. It is imparative that voters understand the stance these elected officials represent and whether or not their decisions line up with the belief of those whom place them in office as the mouth piece of Florida.

    In regards to your assessment of Justice James E.C Perry I had to comment. It is of great concern when people or organizations say things like “better qualified.” Unless you put a resume up side by side, why should I take your word for it? Who exactly are you to say someone is or is not qualified for a position? I suppose the National Rifle Association is a far better organization than the NAACP at endorsements. I truly thought I was a conservative until I realized lately that to be a conservative is riddled with so many other unsavory elements that I no longer wish to be regarded as one.

    I am so glad you were able to shed some light on these difficult decisions. I was concerned that I did not have any information to go on. Reading your advise has given me a clear few on how to vote. I will vote yes where you recommended no and vice versa. Anyone who gets aringing endorsement from someone like you is obviously someone I would like to see removed from office. You mentioned how Ricky Polston has adopted numerous children from the Foster care system. That’s wonderful, given that conservatives like him are one of the reasons so many unwanted or mistreated children are in our state’s overrun foster care system. If choosing adoption is such a wonderful gift, why are so many children still waiting for a forever family?

    Thanks for your biased recs — i will be sure to vote TO RETAIN all the judges you advised against CONSIDERING you are faulting the two SCT justices for following the LAW on the Health Care Bill rather than giving in to the insane Republican agenda. How dare you fault the judges on just on issue IN WHICH they did exactly what they ought to … follow the law. You do know they are both Republician appointments. And to all of you who are relying on some stranger on the internet to TELL you how to vote … are you still amazed that the rest of the world thinks the American public is the dumbest group of people in the universe.     Hmmm…. Has anyone noticed how ‘Gay’ seems to have become synonymous rude, militant, and completely self-serving attitudes? While there are several homosexuals in my life that I consider friends, they are flanked by organized groups with vicious and attacking tactics which demonstrate the desire to promote personal and selfish “perceived-rights” at the exclusion of the rights of others – – even the innocent and unborn.

There are many disconnects in your reasoning. This may come as a surprise to you, but many Americans consider activist Fundamentalist Christian judges a threat. And any further intrusion into our personal lives a threat. I will be voting to eliminate most of your recommendations for the bench.

    I wondered who the liberal judges are. I did not have time to find out. I am an European immigrant from Spain which is ultra liberal, at least when compared to USA.

    “Family values” in USA :

    spreading hatred toward gays.

    Family values in European Union:

    1) One year maternity leave for each child

    2) Ability to add your sick parent to your health insurance policy

    3) Ability to obtain health care policy with “preexisting condition”

    4) Free education system for everyone, even most poor kids

    5) Politicians who do not talk about family values, but put their deeds where their mouth are.

  4. What about the rights of children to be free from social experimentation? Until recent, no nation in history has ever allowed two daddies or two mommies to raise children. Homosexual adoption experiments with children and places children in an environment where they are more likely to be molested and raped. Obviously, the reason that homosexuals want to adopt is that they can’t have children of their own because isn’t not natural for two men or two women to have intimate, sexual relations with each other. Homosexuals also often work their way into the priesthood, coach little league, or volunteer with the boy scouts and other places of trust with children.

    To the homosexuals who read this, I don’t hate you. I love you, and Jesus loves you. God has forgiven me of many sins, and He can forgive you for the sin of homosexuality as well and set you free so that you can be straight.

    As far as reproductive choices, what choices are you speaking about. We’ve already mentioned that homosexuals can’t reproduce. When you speak of choices, do you mean the choice to abstain from sex until marriage? Do you mean marrying someone of the opposite sex and being faithful to them in marriage? I think not. I think you mean the right to terminate the pregnancy, i.e. the right to rip the arms and legs off of a living human being and crush her skull. Just because you can’t see a preborn child, doesn’t mean you can murder that child.

    When you speak about rights, you forget the children who will be harmed by exposure to a perverse lifestyle and the children killed by abortion.

    I was born in New York City, so technically I am US citizen by birth. I was born to Spanish mother and yankee father. I was raised, however, in Spain and I am now married to an american (man). I do have dual citizenship and a rare privilege: I can choose between both systems. Living in the USA and in EU gives me the privilege to clearly see differences than a person who lived only in one system – like you pastor – cannot see. I am not ashamed to voice my opinion.

    In Spain and in the rest of the EU, one can not be dropped from medical insurance because a major illness is costing too much or because of a “pre-existing condition”. In my native tongue the word for preexisting condition does not even exist. I am particularly appreciative that in EU even an infirm or elderly parent – not merely a spouse and children – can be added to an insurance policy. US insurance companies and their lobbyists are well aware of – and wary of – the elderly infirm and associated “costs”. As you might already know, the U.S. health system is the most expensive, however, it consistently under-performs compared to the other developed countries.

    There are many reasons contributing to the extraordinary cost of per-capita expenditure in the USA. In my opinion the most significant is lobbying. There are many lobbies trying to make big bucks out of the misery of sick Americans, including the MD lobby. Equally if not even more complicit are the insurance, pharmaceutical, hospital, and trial lawyer lobbies. Lobbying is truly a corruption, or better the cancer of today’s American society, taking a very serious toll on the overall economy. The practice is socially reprehensible and rife with greed. The only reason lobbyists are allowed to exist is that the general public (which pays the price) is not very aware of what lobbyists do.

    I am appreciative of the 16 weeks 100 % paid maternity leave and the 20-week average paid maternity leave in the EU. Compare this to 0 weeks of paid maternity leave in the USA.

    In the EU, the concept of “family values” does not focus around exposing unfaithful spouses or constant anti-gay rhetoric. EU governments clearly know that citizens want something more “concrete”, such as laws that help families stay together, educate their children without dehabilitating tuition costs, and protect them with affordable healthcare.

    The gap between the rich and the poor in the US is widening at alarming proportion. With changing demographics in the USA , this is going to become a major – very major – factor if the US is going to continue to prosper.

    The USA is a still a rich country; however, the United States ranks dead last on almost all measures of equity because the country has the greatest disparity in the quality of care given to rich and poor citizens. Americans with below-average incomes are much less likely than their counterparts in other industrialized nations to see a doctor when sick, to fill prescriptions or to get needed tests and follow-up care. If you are Donald Trump, you can afford the very best medical care in the USA , or you can go overseas. But if you are an average Joe, possibly without insurance or at the mercy of the whim of a private profit-seeking insurer, the system in the EU is clearly superior.

    Where did you get this data? Was it published in any peer reviewed journal supported by statistical data using a control group? Or is anecdotal “evidence” created by family “research” council?

    You say that it is not natural for two men or two women to have intimate, sexual relations with each other. I ask you how do you know that if you are not homosexual yourself? If you feel bad about your own homosexual feelings, decided to repress them, got married to cover your true nature, it does not mean that everyone should follow your steps. How come that the most rabid anti gay priests get exposed so often as self hating homosexuals?

    You say that that homosexuals can’t reproduce. This is not true. Many homosexuals have biological children with the person of the opposite gender.

    To the narrow minded self hating self repressed homosexuals who read this, I don’t hate you. I love you, and Jesus loves you. God has forgiven me of many sins, and He can forgive you for the sin of self repression as well and set you free so that you can be trully who you are.

    In EU, average poor HAS access to medical care and free education. Kid born to poor parents in EU can easily become a lawyer or a doctor since that there is no scholarship to be paid. In USA, on the contrary, there is little or no tuition protection. I did not go in debt to become a doctor in Spain and neither did any other student in the EU. In this regard, the systems in the EU provide an equal start in life relative to education for all its citizens. Unlike in the USA, in the EU, one does not have to be born to well-off parents, does not have to get a student loan, and does not have be distracted while working part-time as a waiter to pay for tuition.

    I am the first to acknowledge that we Europeans started two horrible wars and “invented” two bad systems: Communism and Nazism. We paid a terrible price for those blunders.

    However, in the last half-century we learned a lot from the USA. The EU itself is a product of that learning. The European Union is growing rapidly – in fewer than 50 years, the EU has become the world’s largest economy, surpassing the USA . In addition, the Euro (that is the form of currency used by most countries of the European Union, since you may not know) rose 50 % against the US dollar in only 10 years.

    Your letter is rife with contradictions. You claim that no society at any time in history prior to recently placed children in a home with two men or two women and that doing so is an experiment. But on the other hand, you already know (from where?) that children raised by two men or two women are more likely to be exposed to abuse or rape. Here you are lost in your own contradiction.

    You claim that you thought you were happy with yourself until me, who don’t even know you, informed you otherwise. I can reply that your posts say much more about you than you think. You are not talking about homosexuals around you, no, you are talking about repressed homosexual desires inside you.

    Tell me pastor, why would a 100 % straight man you claim to be, try to curb rights and take away dignity from gay people? Why would a straight man even care about gays? Why???

    I’m voting the opposite of everything you said here. I had my ballot basically all figured out already. But I wanted to do some extra research on the judges. I was finding it difficult.. but on most I had already decided how to vote, but this article made it clear to me. The NO votes I had were reinforced and the ones I wasn’t sure on, now I am. Thanks for clearing things up for me!

    The Christian Coalition 2nd District Judge keep or drop list conflicts with most conservative voting guides. Most conservative sites have:
    Crenshaw No
    Kelly No
    Khousam Yes
    Morris No
    Wallace Yes

    The only 2 mutual are Northcutt and Villanti.

    Why is this.

  9. My list for District Judges came from http://www.unitedchristiansofflorida.com referenced in the article. They are the only conservative voter guide on the judges that I have seen other they mine. The Florida Family Policy Council has a guide, but it merely reports what the bar association attorneys think of the judges. If you are aware of others, by all means utilize them, and share the links on this page.

    Seriously, if you brag so much about how great Europe is, why are you here? Enjoy your freedom much? You know you brag about all the ‘free’ services that other countries provide, but you failed to mention what the tax bracket is for middle class folks there? If you propose that high price of 30, 40 and as much as 60% income taxes here you would see a mob want to lynch you; You truly are a fool. Our upper class does pay significantly more than the less wealthy here. I grew up in a poor family, put myself through college, and through hard work, now have worked on some of the most challenging and rewarding programs in this country. I have been rewarded for my work. I was not born entitled as you believe everyone is. In THIS COUNTRY, you get what you WORK for! Now get off your lazy but and move back to Europe because if you disrespect my country again, I will kick your lazy fat butt back to where you belong. You say how well off Europe is, but why do they always trail the U.S.? Why do they need our protection every time there is a tyrant on the rise? Because they do not know the puritanical work ethic. European GDPs and productivity is a joke, and that is why the unruly mobs are burning the streets of France. …and check your facts, the EU model is unsustainable because for the first time in history your population is on the decline. If you don’t know what that means, go back to economics 101. This country may not be perfect, but we tolerate everyone, even idiots like you who have no true rights to claim citizenship.
    …and I did work when I went to college. I was hired into the United States Space Program because I showed I could maintain my grades AND work. That is what a work ethic is woman. If you want entitlement, move to the U.S.S.R., that is, if you can find where it went!
